Since March 2021, the Divorce Act has used the expression “parenting time” instead of “custody” and “right of access” to refer to the time that the child spends with each parent. It is therefore this expression that you could find in your legal proceedings and in the judgments rendered by the courts.

However, the expressions “custody” and “right of access” remain in force for de facto spouses.
